Foley was born in Kansas City, Kansas and is the oldest of three sons. Throughout his childhood he traveled a lot due to his father's career as an international banker. Foley's mother passed away when he was 15.

Foley's breakthrough role was on "Felicity," playing Noel Crane. He also has had recurring spots on "Scrubs" and "Dawson's Creek" and guest starred on "House" as a steroid-using baseball player. He was nominated for a Teen Choice Award for his villainous role in "Scream 3." Foley also had a starring role in the CBS drama "The Uni,t" playing Sergeant First Class Bob Brown.
