"HEROES FACE SLIDER" CONTEST
Official Rules
No purchase necessary to enter or win. Void where prohibited. The "Heroes Face Slider" Contest ("Contest") begins on June 4, 2008 at 4pm and ends on July 21, 2008 at 4pm. All times in this Contest refer to Eastern/Pacific Time. This Contest is sponsored by NBC Universal, Inc., 30 Rockefeller Plaza, New York, NY 10112 (the "Sponsor").
Eligibility: Open only to legal U.S. residents physically residing in the United States and the District of Columbia (residents of Guam and Puerto Rico are excluded from entry and participation) who are who are 13 years of age or older as of date of entry. An eligible minor must have his or her parent's or legal guardian's permission to participate in this Contest. Employees of Sponsor and its respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and any other entity involved in the development or administration of the Contest, and their immediate family members (parent, child, spouse, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related, are not eligible to participate or win in the Contest. Void where prohibited or restricted by law.
HOW TO ENTER: If you are considered a minor in your jurisdiction of residence, you must have your parent's or legal guardian's permission to participate. Beginning at 4pm on June 4, 2008 through 4pm on July 21, 2008 (the "Contest Period"): 1) Log onto http://www.nbc.com/heroes (the "Website") and click on the "Heroes Face Slider" Contest banner or link; 2) Follow the on-screen entry instructions and complete the Official Entry form in its entirety (including participant's full name, valid email address and date of birth); 3) Create your version of Penny's alter ego by using the "Face Slider" to create "Penny's Face" and entering an "Alias" name for Penny (collectively "Alter Ego"); and 4) Submit your entry. There is no restriction on the number of times that you may enter the Contest. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. For any participant's entry to be valid and in order for his or her entry to be considered, participant must acknowledge reading, accepting, and agreeing to the terms and conditions set forth in these Official Rules.
TERMS OF SUBMISSION: Your Alter Ego, Entry Form, and any other materials you submit (collectively, the "Submission") may be used on the Website, or in any other manner as you have submitted it, or as modified by Sponsor or others involved with the Heroes Graphic Novel in their sole discretion. Any Submission that, in the sole discretion of Sponsor, is deemed defamatory, harassing or otherwise inappropriate for publication will be disqualified. All Submissions must be original, truthful, unpublished, created solely by the submitting entrant, must not have been submitted in any other competition, and must not infringe upon any rights of any third party, including but not limited to copyright, trademark, and rights of privacy and publicity. Your Submission also must not contain inappropriate or offensive material or libelous, tortious, or otherwise unlawful information, or violate any federal or state statute or regulation. Submissions generated by a script, macro or other automated means will be disqualified. Submissions that are incomplete, illegible or corrupted are void and will not be accepted. All Submissions become the property of the Sponsor and will not be acknowledged or returned.
If you provide a Submission, you are granting the Sponsor, and each of its licensees, successors and assigns a worldwide, royalty-free, perpetual, and irrevocable license to use, modify, distribute, create derivative works and display your Submission on the Website and/or on any other website, in any form, in any and all media now known or hereinafter developed, throughout the world, in perpetuity. You will not be paid or receive compensation of any kind for your Submission or for granting Sponsor any of these rights. Your entry will not be acknowledged, returned or held "in confidence." All elements of any Alter Ego shall be within the sole discretion of the Sponsor.
You will not be given credit if your Submission is used, except that Sponsor may, in its sole discretion, post your name (or, if an eligible minor, his or her parent or legal guardian's name) in connection with your Submission. You hereby consent to your Submission being published, and to the use of your name and as provided by you, including, without limitation, for purposes of advertising, promotion and publicity, all without compensation. The decision to post or use any Submission is solely within Sponsor's discretion, and Sponsor has no obligation to make any use of any Submission.
The images provided on the Face Slider and the Face Slider (together "Face Slider") are for use in connection with your Submission only. Your use of the Face Slider does not operate to give you any rights in or to the Face Slider and you may not use the Face Slider in any other manner or for any other purpose. As between you and Sponsor, Sponsor shall be the sole and exclusive owner of any and all rights in and to the Face Slider. Without in any way limiting the foregoing, you acknowledge and agree any material included as part of the Face Slider are owned by NBC Universal, Inc. and may be used by you only in your Submission and only for use and exhibition by Sponsor in accordance with this Agreement. Your violation of any of these provisions or your unauthorized or improper use of any of the Face Slider shall void your entry and disqualify you from the Contest and shall entitle NBC Universal, Inc. and Sponsor to pursue all legal and equitable rights and remedies, including, without limitation, an action for copyright infringement as well injunctive relief and damages.
By entering the Contest, entrants (and, if eligible minors, their parents or legal guardians) agree to waive any right to claim any ambiguity or error in these Official Rules or the Contest itself, and agree to be bound by these Official Rules and by all decisions of the Sponsor, whose decisions are binding and final. Entrants must also be of good moral character. Sponsor reserves the right to exclude anyone convicted of a crime (other than moving violations of a misdemeanor type that did not involve personal injury, drugs or alcohol). Entrants must have nothing in their background that would be an embarrassment to Sponsor and entrants may not be elected officials or currently running for any political office (local, state or federal). Sponsor reserves the right to exclude applicants for these or any other reasons, in Sponsor's sole editorial discretion. Sponsor reserves the right to make public personal information about the entrants on the nbc.com website, prior to, during, or following the Contest.
Entries that are incomplete or illegible are void and will not be accepted. All entries must be received before 4pm on July 21, 2008. By participating, entrants unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Sponsor.
ONLINE VOTING: From 4pm on June 4, 2008, 2008 through 4pm on July 21, 2008 (the "Voting Period"), visitors to the Website will be able to vote for his or her favorite Alter Ego (according to the voting rules and procedures established by Sponsor, which will also be posted on the Site). At the beginning of the Voting Period, all valid Submissions will be posted on the Website in a randomized manner. Once posted, the randomized order will not change. After viewing the Alter Egos, visitors may vote by clicking on the circle under the Alter Ego and then clicking on "Submit". At the close of the Voting Period, the four (4) Alter Egos with the most votes will be deemed the Finalists ("Alter Ego Finalists"), subject to verification of eligibility. Results of the Online Voting can be followed by visiting the "Leaderboard" link on the Website. In the event of a tie, Judges (as defined below), in their sole discretion, will break the tie by selecting the Alias name with the most creativity. The Voting Period and method of voting may be subject to change, in Sponsor's sole discretion, and any changes will be posted on the Website. Submissions received after the July 21, 2008 deadline will not be posted online and will not be eligible for Online Voting or Judging (as defined below). Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply.

JUDGING: After Online Voting concludes, the four (4) Alter Ego Finalists will be judged by employees or representatives of Sponsor (the "Judge(s)") in order to select (1) Winner. Each Alter Ego will be judged and scored by one or more of the Judges, in their sole discretion, based on the following criteria: (i) the originality and creativity of Penny's Face and (ii) the originality and creativity of Penny's Alias name (collectively the "Criteria"). In the event of a tie, the Alter Ego with the most original and creative Alias name will be selected as the Winner, as determined by Sponsor in its sole discretion. The decisions of the Judge(s) are final and are not subject to challenge or appeal.
The selection of Finalists, the Winner and the judging Criteria is at Sponsor's sole discretion.
WINNER NOTIFICATION: One (1) potential Winner will be announced by Sponsor on or about August 4, 2008. The Winner's name (or, if an eligible minor, his or her parent or legal guardian's name) may, in the sole discretion of Sponsor, be posted on the Website. If the Winner is disqualified or otherwise unable to fulfill the requirements asked of him or her, Sponsor reserves the right to pick the entrant with next highest Criteria as the Winner. Sponsor will make two (2) attempts to contact the potential winner(s) at the phone number or e-mail address provided at the time of entry. If Sponsor is unable to reach a potential Winner via phone or email after two (2) attempts, he or she may be disqualified and an alternate may be selected. The potential Winner (and, if an eligible minor, his or her parent or legal guardian) will be required as a condition of continued eligibility to complete and sign an Affidavit of Eligibility, Waiver of Liability and Publicity Release ("Contest Documents") within seven (7) days of attempted delivery. If for any reason the potential Winner does not meet any of the above eligibility requirements or does not satisfactorily execute all of the Contest Documents, in Sponsor's sole discretion, the Judges may select an alternate Winner based on the above judging Criteria.
PRIZE: The Prize consists of the opportunity for one (1) potential Winner to have his or her Alter Ego featured in an upcoming 2008 Heroes Graphic Novel, as designated by Sponsor. If the Heroes television program or the Heroes Graphic Novel are cancelled or discontinued for any reason no additional Prize will be awarded. The creation of the Alter Ego has no cash value. No payment or compensation will be awarded to the Winner and the Prize is not to be considered an employment opportunity. Prize is non-transferable and no substitution will be permitted, except by Sponsor in its sole discretion. If the Prize is won by a minor, Prize will be awarded to his or her parent or legal guardian. Sponsor may change, edit, remove or cancel the potential Winner's Alter Ego appearance in the Heroes Graphic Novel in whole or in part in its sole discretion. Winner agrees that the Heroes Graphic Novel and the Alter Ego are owned by Sponsor and may be broadcast or used by Sponsor at any time without affording the Winner any additional compensation. Notwithstanding the above, Sponsor is not under any obligation to broadcast or otherwise use the Winner's Alter Ego and any decision to do so is in Sponsor's sole and exclusive discretion.
GENERAL RULES: Entry of Submission constitutes permission to the Sponsor and its designees to use each entrant's name (and, if an eligible minor, his or her parent's or legal guardian's name), city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law. By participating, entrant is stating (i) he or she is the sole creator and proprietor of the entry component and that the entry was not taken from any published materials; (ii) agrees to release and hold Sponsor, its respective parents, affiliates, subsidiaries, and advertising and promotion agencies, any other entity involved in the development or administration of the Contest, and each of their respective directors, officers, employees and assigns (collectively, the "Released Parties"), harmless against any and all claims and liability of any kind (including, without limitation, personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy) arising in whole or in part, directly or indirectly, out of participation in the Contest or the acceptance, receipt, possession, misuse, nonuse or use of any prize (or portion thereof); (iii) waives all rights to claim direct, indirect, punitive, incidental and/or consequential damages, attorney's fees or any damages other than actual out-of-pocket costs incurred to enter; and (iv) agrees to be bound by these Official Rules and the decisions of the Sponsor and Judges which are final and binding on all matters relating to the Contest.
Released Parties are not responsible for incomplete, lost, late, stolen, damaged, illegible, misdirected, garbled, inaccurate, delayed or undelivered entries or mail; or for technical, hardware or software malfunctions, difficulties or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled, stolen, incomplete, misrouted, or delayed computer transmission, which may limit an individual's ability to participate. Released Parties are not responsible for any computer, network, technical, mechanical, printing, typographical, human or other errors or problems of any kind relating to or in connection with the Contest, including, without limitation, errors or problems of any kind that may occur in connection with the administration of the Contest, the processing of entries, the announcement, delivery or use of any prize or in any Contest-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest.
CAUTION: Any attempt by an entrant to deliberately damage any Web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution.
Sponsor reserves the right to postpone, cancel, or modify the Contest (or any element thereof, including, without limitation, these rules and/or the Prize) in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these rules) without notice, in its sole discretion. Sponsor also reserves the right in its sole discretion, to cancel, suspend or modify the Contest, or to disqualify any implicated entrant(s) (and void associated entries), if any fraud, virus, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Contest, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to conduct judging and to award prize(s) for the applicable Contest Period from among all eligible, non-suspect entries received for that Contest Period up to the time of the event or action warranting such cancellation. In the event this Contest is cancelled prior to the stated end date, a notice will be posted on the Website.
Sponsor may prohibit any entrant or potential entrant from participating in the Contest and/or receiving any prize (or any portion thereof), if at the sole discretion of Sponsor, such person shows a disregard for these Official Rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or their agents or representatives or (2) in any other disruptive manner.
In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. "Authorized account holder" of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
ENTRANT'S PERSONAL INFORMATION: Information collected from entrants is subject to the NBC Privacy Policy (http://nbcuni.com/Privacy_Policy/).
GRAND PRIZE WINNER'S NAME: For the name of the potential Prize winner(s), go to http://www.nbc.com/Winners after August 4, 2008.
The selection of Finalists, the Winner and the judging Criteria is at Sponsor's sole discretion.
WINNER NOTIFICATION: One (1) potential Winner will be announced by Sponsor on or about August 4, 2008. The Winner's name (or, if an eligible minor, his or her parent or legal guardian's name) may, in the sole discretion of Sponsor, be posted on the Website. If the Winner is disqualified or otherwise unable to fulfill the requirements asked of him or her, Sponsor reserves the right to pick the entrant with next highest Criteria as the Winner. Sponsor will make two (2) attempts to contact the potential winner(s) at the phone number or e-mail address provided at the time of entry. If Sponsor is unable to reach a potential Winner via phone or email after two (2) attempts, he or she may be disqualified and an alternate may be selected. The potential Winner (and, if an eligible minor, his or her parent or legal guardian) will be required as a condition of continued eligibility to complete and sign an Affidavit of Eligibility, Waiver of Liability and Publicity Release ("Contest Documents") within seven (7) days of attempted delivery. If for any reason the potential Winner does not meet any of the above eligibility requirements or does not satisfactorily execute all of the Contest Documents, in Sponsor's sole discretion, the Judges may select an alternate Winner based on the above judging Criteria.

Notwithstanding the above, Sponsor is not under any obligation to broadcast or otherwise use the Winner's Alter Ego and any decision to do so is in Sponsor's sole and exclusive discretion.

Released Parties are not responsible for any computer, network, technical, mechanical, printing, typographical, human or other errors or problems of any kind relating to or in connection with the Contest, including, without limitation, errors or problems of any kind that may occur in connection with the administration of the Contest, the processing of entries, the announcement, delivery or use of any prize or in any Contest-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest.
CAUTION: Any attempt by an entrant to deliberately damage any Web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution.
Sponsor reserves the right to postpone, cancel, or modify the Contest (or any element thereof, including, without limitation, these rules and/or the Prize) in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these rules) without notice, in its sole discretion. Sponsor also reserves the right in its sole discretion, to cancel, suspend or modify the Contest, or to disqualify any implicated entrant(s) (and void associated entries), if any fraud, virus, actions by entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Contest, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to conduct judging and to award prize(s) for the applicable Contest Period from among all eligible, non-suspect entries received for that Contest Period up to the time of the event or action warranting such cancellation. In the event this Contest is cancelled prior to the stated end date, a notice will be posted on the Website.
Sponsor may prohibit any entrant or potential entrant from participating in the Contest and/or receiving any prize (or any portion thereof), if at the sole discretion of Sponsor, such person shows a disregard for these Official Rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or their agents or representatives or (2) in any other disruptive manner.
In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. "Authorized account holder" of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
