Eligibility: "TELL TRUMP," The Apprentice viewer game ("Promotion") is open only to persons who, at the time of entry, are eighteen (18) years of age or older and legal residents of, and are physically present in, the 50 United States and the District of Columbia (excluding Puerto Rico, Guam and the US Virgin Islands). Employees of Mark Burnett Productions, NBC Universal, Inc. and m-Qube, Inc., their advertising and promotion agencies involved with this Promotion, including Interpolls Inc., and their subsidiaries, divisions, affiliates and related companies, immediate family members and/or those living in the same household of such employees are not eligible to participate or win. By entering the Promotion, participants are bound by and agree to these official rules. All federal, state and local laws and regulations apply. Void where prohibited by law.
Sponsors/Administrator: The Sponsors of the Promotion are NBC Universal, Inc., 3000 W. Alameda Ave., Burbank, CA 91523 and m-Qube, Inc., 311 Arsenal Street, Watertown, MA 02472 (collectively the "Sponsors"). The Administrator of the Promotion is Interpolls, Inc., 8 Mills Place, 2nd Floor, Pasadena, CA 91105 (the "Administrator").
Promotion Period: The Promotion begins at approximately 10:00 P.M. (ET) on May 29, 2006 and ends at 11:00 PM (ET) on June 5, 2006 or such other time period during which THE APPRENTICE final episode is aired in, whole or in part, in any of the three time zones on such date (the "Promotion Period").
Promotion Description: During the week prior to and during THE APPRENTICE Series V final episode that is aired during the Promotion Period, viewers will be invited to participate in the Promotion (check local listings for dates and times when THE APPRENTICE is aired). Beginning approximately 10:00 PM ET on May 29th 2006, viewers will be invited to participate in the Promotion by stating which candidate they think deserves to be "hired" in THE APPRENTICE Series V final episode. The question will have two possible answers for the two finalists (the "Question"). Each candidate will be assigned a "letter" (i.e. A and B) which viewers can either send as a text message from their cell phone or vote online. The promotion will run for one week up to and including THE APPRENTICE Series V final episode which will air between 9:30 PM and 11:00 PM ET on June 5th, 2006. Promos will air on NBC during that week to remind viewers to vote. Note that although voting results will be shared with Donald Trump prior to his decision to hire a candidate, Mr. Trump's decision is entirely his and may or may not reflect the "Tell Trump" result.
All entrants who vote, regardless of their answer to the Question will be entered into the Grand Prize random drawing. One (1) Grand Prize winner will be selected during the Promotion Period.
How To Register and Enter by Cell Phone: If you have a text messaging-capable cell phone from a participating carrier, you may enter the Promotion once prompted to do so by the announcer, by sending a text message to the short code 51515 with your guess of the letter corresponding to an answer to the question (ie A or B). A premium text message charge of $.99 will apply to all text message entries sent in connection with the Promotion. In addition, standard text messaging rates apply to all other text message entries sent in connection with the Promotion. You may stop receiving text messages at any time by responding "end", "stop" or "quit" to the thank you text message or to any of the messages. For every entry submitted via text messaging, you will receive one (1) entry into the Grand Prize random drawing to select the Grand Prize Winner. Please do not drive while participating in the registration/entry process.
Free Method of Entry Online: To enter the Promotion without using a cell phone, visit /apprentice/telltrump/vote.shtml and complete the online registration, including your guess of the number corresponding to the correct answer to the question. For every guess submitted online, you will receive one (1) entry into the Grand Prize random drawing to select the Grand Prize Winner.
Limit twenty (20) entries per person, regardless of method of entry. All text message/online entries must be received within the Promotion Period.
Conditions for Participation and Validation of Entries. Entries generated by a script, macro, robotic or other automated means will be disqualified. USE OF COMPUTER PROGRAMS TO ENTER AND/OR OTHER AUTOMATIC ENTRY METHODS, (SUCH AS HACKS OR BOTS), REGARDLESS OF METHOD OF ENTRY IS STRICTLY PROHIBITED. Sponsors reserve the right to disqualify, block or discard any entries from any individual who enters by any kind of electronic, mechanical or other automated means or otherwise tampers with or hacks the entry process as determined by the Sponsors in their sole discretion. Sponsors also reserve the right, in their sole discretion, to cancel, modify or suspend the Internet, electronic or text-messaging portions of the Promotion in the event of a computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failure or disruption, force majeure or any other causes which, in their sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Please note, by entering, you agree that if selected as a winner, Sponsors have the right (but not the obligation) to announce your name, home city, and state, and to air your voice live on-air during the Show. Sponsors are not responsible for late, lost or incomplete entries, which will be disqualified.
Random Drawings: There will be a total of 1 Grand Prize drawing. On the date that THE APPRENTICE Series V Finale is aired during the Promotion Period, one Grand Prize winner will be selected in a random drawing from among all eligible entries received. m-Qube, whose decisions will be final and binding in all matters related to this Promotion, will randomly select the potential Grand Prize winner. Decisions of m-Qube are final and binding. Entrants selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Promotion prizes are non-transferable, non-refundable and no substitutions will be permitted. Sponsors reserve the right to substitute a prize of equal or greater value in the event of prize unavailability. All federal, state and local taxes are the sole responsibility of winners. Due to the nature of national Network broadcast television, the broadcast date and time is subject to change. In the event THE APPRENTICE Series V Finale is cancelled, the Promotion will terminate as of the date of cancellation and the Grand Prize for the cancelled show will not be awarded. In the event THE APPRENTICE Series V Finale is cancelled or preempted after a Show is already airing, and in the event any portions of the Promotion are canceled, modified or suspended, the Grand Prize will be awarded from among those eligible entries received prior to cancellation or preemption, if any.
Prizes and Approximate Retail Values:
Grand Prizes: Sponsors will award one (1) Grand prize consisting of $30,000. The total value of all Grand Prizes for the entire Promotion is $30,000.
All expenses and costs not expressly listed above, including, but not limited to, taxes, tips, transfers, or any other fees are winner's sole responsibility.
Prize is non-transferable; no substitutions or cash equivalents allowed, except at the sole discretion of Sponsors, who reserve the right to substitute a prize of comparable or greater value. If winner cannot accept prize as stated, or does not complete the prize documentation within seven days of receipt, prize will be forfeited and an alternate winner selected. Limit one prize per household. All federal, state and local taxes and other expenses and incidentals not specified herein are the sole responsibility of the winner. Sponsors responsible only for prize delivery; not responsible for prize utility, quality or otherwise. In the event a winner is deemed a minor in his/her state of residence, prize will be awarded in the name of parent/legal guardian. No substitution permitted, except by Sponsors, who reserve the right to substitute a prize with another prize of equal or greater value.
Winner Notification: Potential Grand Prize winner will be notified by phone. m-Qube will make one (1) attempt to contact the potential Grand Prize winner at the phone number provided online or at the cell phone number used to enter within five (5) minutes from the time winner selection was accomplished on the applicable air date. If m-Qube is unable to reach a potential Grand Prize winner via phone within this time frame, he/she will be disqualified and an alternate will be selected. The potential Grand Prize winner (or the parent/legal guardian if winner is a minor in his/her state of residence) will be required to execute and return a notarized affidavit of eligibility/release of liability and publicity release (where legal) within seven (7) days of attempted notification. If the potential Grand Prize winner cannot be contacted or fails to sign and return the affidavit of eligibility/release of liability and publicity release within the required time period (if required), potential Grand Prize winner (as applicable) forfeits prize even though his/her name may have been shown/announced on air. If prize is returned as undeliverable, potential winner forfeits prize. In the event that the potential Grand Prize winner is disqualified for any reason, Sponsor will award the prize to an alternate winner (selected from among all eligible entries received for the Grand Prize), even if the disqualified potential Grand Prize winner's name may have been shown/announced on air. Odds of winning a Grand Prize depend on number of eligible entries received during the entry period.
General Conditions:
a. By entering, entrants fully and unconditionally agree and accept to be bound by these complete Official Rules and the decisions of Sponsors, which shall be final. Sponsors have the right to modify these rules in their sole discretion for clarification purposes without materially affecting the terms and conditions of the Promotion.
b. Except where prohibited, all winners grant to Sponsors and their advertising agencies the right to use, and publish his or her proper name, likeness, voice, opinions, biographical information and state and to announce winner's full name, home city and state on-air during any broadcast of the Show, as well as in any other media in which the Show is exhibited or to promote Sponsors and the Promotion, without additional compensation.
c. Entrants enter at their own risk. Sponsors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incorrect, incomplete, ineligible or unintelligible entries; (ii) telephone, electronic, hardware, software program, network, Internet or computer failures or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Sponsors that may cause the Promotion to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of a prize, or from participation in the Promotion; or (vi) any printing or typographical error in any materials associated with these Official Rules or the Promotion generally. Entrants assume all liability for any injury or damages caused or claimed to be caused by his or her participation in the Promotion and/or the acceptance and/or use of any prize, and release Sponsors and their respective officers, directors, employees, parents, subsidiaries and affiliates from any such liability. Sponsors and their respective officers, directors, employees, parents, subsidiaries and affiliates assume no responsibility for any injury or damage to participants or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with this Promotion.
PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES, ONLINE OR BY SMS (TEXT MESSAGING), OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE GAME OR A DELAY IN THE PROCESSING OF ENTRIES SUCH THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. SPONSORS ARE NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS.
d. Sponsors may prohibit any entrant or potential entrant from participating in the Promotion, if at the sole discretion of Sponsors, such person shows a disregard for these Official Rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or their agents or representatives; or (2) in any other disruptive manner.
e. In the event of a dispute as to the identity of an entrant, the authorized account holder of the cellular phone or email address used to enter, if applicable, will be deemed to be the entrant. "Authorized account holder" of a cellular phone is the natural person in whose name the phone has been issued and to whom services are billed. "Authorized account holder" of an email address is defined as the natural person who is assigned to an email address by an Internet Service Provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
f. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsors in connection with the Promotion, shall be governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of California. Sponsors' decisions as to all matters related to the administration of the Promotion and selection of the prize winners are final.
Winners' List: Each Grand Prize winner's name and home city will be aired on television at the end of each Show. In addition, a complete winners' list will be posted online at the Show's website, /apprentice after 6/25/06.
